O presente texto trata dos direitos fundamentais do profissional da Arquitetura em relação ao projeto. Estabelece que o profissional tem direito de acompanhar a execução da obra, evitando modificações que a descaracterizem. Se houver modificações não autorizadas pelo criador intelectual, pode o arquiteto romper o vínculo de paternidade da obra modificada. Trata ainda das questões relativas à reprodução da obra arquitetônica e conclui fazendo uma distinção entre o projeto original e sua execução material, distinção esta que gera os direitos que foram antes mencionados. INTELLECTUAL RIGHTS OF THE ARCHITECT Abstract The paper focuses on architect´s basics intellectual property concerning the project. It sets the architect has the fundamental right to track the work in execution, avoiding changes that take off its feature. If edits has been made without permit, the architect is allowed by the law to deny that work. At last, it also broaches issues about architectonic work reproduction and concludes making a distinction between the original architectural work and its execution, which is at the frame of the professional rights.
